How does Italian nationality law work?

The Italian Citizenship Law offers one of the most accessible routes to obtaining European nationality thanks to its unique characteristics:

No generational limit: Unlike other countries, Italy does not impose generational restrictions, allowing any direct descendant to apply.

Patrilineal and matrilineal transmission: Before 1948, Italian citizenship was transmitted exclusively through the paternal line. However, for cases of maternal lineage prior to this date, it is possible to apply for citizenship through the courts.
After 1948: Both men and women can pass on Italian citizenship to their descendants.
No residency requirement: The law allows you to obtain citizenship without the need to reside in Italy.

Who can apply for Italian citizenship?

There are two main scenarios for descendants of Italians:

Pre-1948:

    • paternal lineIt automatically transmits nationality to children, allowing them to apply for citizenship through administrative channels.
    • Maternal lineIf the ancestor was born before January 1, 1948, the legal route must be used to obtain citizenship.
  •  Post-1948:

    • Any Italian born after 1948 transmits their nationality directly, and can initiate the process administratively.
